That is, the seller lists things at a low starting bid without a reserve and if the winning bid is lower than they want to accept, they simply never ship the item and then offer a refund. Do the buyers have a similar option? If I win an auction and decide that my winning bid was too high, can I simply not pay for it and tell the seller to keep the item?
Of course not since I enetered into a contract. Ebay's money back gaurantee doesn't help eliminate these scammers since all they do is refund the money and there is no penalty to the seller. In my case almost all the seller's negative feedback had to do with items not received.
Rather than just have negative feedback, Ebay needs to either delete these seller's accounts or pealize them 10 times the cost of the item and make them ship it. Yes, you can. You just have to deal with the consequences which are next to nothing these days for buyers of your actions.
The seller gets a defect for the open case. Sellers are not allowed a large amount of defects unless they are the big box stores Ebay actually wants here. First of all, they are not scammers. You lost no money. You are only inconvenienced, not scammed.
